However, the practice of paying parking leases is not without problems. One of them is the practice of parking and paying at Panyabungan. This study aims to describe the practice of paying for parking in Panyabungan. Because of this, this research will describe how the parking payment system in Panyabungan City is and how Islamic law views this parking payment. The research method used in this research is field research, namely research with data obtained from field activities. Methods of data collection by using the method of observation, interviews and documentation. Furthermore, the data that has been obtained is analyzed qualitatively by forming conclusions through deductive. The results of the study explain that the parking payment system in Panyabung does not include tickets or other proof of payment. This is because the parking rate stipulation from the Transportation Service as the basis for enforcing the amount of the figure has not been fully implemented. Meanwhile, Islamic law stipulates that the contract of a transaction must be carried out in a transparent and mutually acceptable manner.</em></p> <p><strong>Abstrak</strong><strong>: </strong>Fenomena pengelolaan areal parkir menjadi sangat trend pada saat ini. Namun, praktek pembayaran sewa parkir tidak luput dari sejumlah permasalahan. Salah satunya adalah praktek parkiran dan pembayaranya di Panyabungan. Penelitian ini bertujuan untuk mendeskripsikan terkait praktek pembayaran parkiran di Panyabungan. Karena itu penelitian ini akan menggambarkan bagaimana sistem pembayaran parkir di Kota Panyabungan dan bagaimana analisis hukum Islam tentang pembayaran parkir tersebut. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian lapangan yaitu penelitian dengan data yang diperoleh dari kegiatan lapangan. Metode pengumpulan datanya dengan menggunakan metode observasi, wawancara dan dokumentasi. Selanjutnya data yang telah diperoleh dianalisis secara kualitatif dengan pembentukan kesimpulan melalui deduktif. Hasil penelitian menjelaskan bahwa sistem pembayaran parkir di Panyabungan tidak menyertakan karcis atau bukti pembayaran lainnya. Sebab ketetapan tarif parkir dari dinas Perhubungan sebagai dasar pemberlakuan besaran angka belum diberlakukan sepenuhnya. Ahmad Hassan is a reformer who contributed to his thinking in the field of hadith. Ahmad Hassan considered that the predominance of the school Muslims had hindered the interaction of the people with the Koran. In this paper, we will discuss hadith’s thoughts and the contribution of Ahmad Hassan in the studying of Hadith in Indonesia. This research uses a qualitative method of the library research approach. The results of this study show that Ahmad Hassan plays a role in the freedom to understand religious teachings without being bound by a school, according to him, this thinking is expected to reduce obstacles to the progress of the people due to the shackles of the taklid mazhab which has been a tradition since centuries ago. So it can be concluded that Ahmad Hassan is a figure of Hadith figures and scholars who have conducted Hadith studies and played an active role in purifying Islamic teachings in Indonesia.</em></p> Ilham Ramadan Siregar Copyright (c) 2022 Ilham Ramadan Siregar https://creativecommons.org/licenses/by/4.0 2022-12-31 2022-12-31 1 1 20 31 The Problem of Thaha Hussein's Political Thought https://jurnal.stain-madina.ac.id/index.php/religi/article/view/1123 <p><em>This paper tries to explain the political thought of Thaha Hussein which has been considered pro and con because it seeks to juxtapose Western-style Islam and secularism in a country. Thaha Hussein's secularization efforts touched on various aspects</em><em>, including education, culture, religion, and politics.&nbsp; Thaha Hussein in his political thought sought to release Muslims from their dependence on old opinions that were often considered part of religious teachings. In Thaha Hussein's view religion and politics are two different things hence the regulation of the political system and the formation of the state are not based on syar'i but on the interests of society itself. &nbsp;This study is library research. Meanwhile, the method used to process the data that has been collected by the author is the historical factual method. &nbsp;This paper also uses a descriptive method where the author explains and outlines the journey and political irregularities of Thaha Hussein. &nbsp;Thaha Hussein accepted and proposed a concept of secularization that was different from the idea of secularism that occurred in the West. Thaha Hussein points to secularization in the sense of being a process of detaching devotees from the bonds of tradition, including religious teachings that were the predecessors' understanding of the zanni nash-nash, and ending with a return to the Koran and Hadith (meaning inseparable from both). Meanwhile, secularization that occurs in the West, is dotted with the separation of the world</em></p> <p><strong>Abstrak</strong><strong>: </strong>Tulisan ini mencoba memaparkan pemikiran politik Thaha Husein yang selama ini dianggap pro dan kontra karena berusaha menyandingkan Islam<br>dan sekularisme ala Barat dalam suatu negara. Upaya sekularisasi Thaha Husein menyentuh berbagai aspek, diantaranya pendidikan, kebudayaan, agama dan Politik.. Thaha Husein dalam pemikiran politiknya berusaha melepaskan umat Islam dari ketergantungan mereka terhadap pendapat-pendapat lama yang sering dianggap sebagai bagian dari ajaran agama. Dalam pandangan Thaha Husein agama dan politik adalah dua hal yang berbeda karenanya pengaturan sistem politik dan pembentukan negara tidaklah berdasarkan syar’i tetapi berdasarkan kepentingan-kepentingan masyarakat itu sendiri. Kajian ini merupakan library research. Sedangkan metode yang digunakan untuk mengolah data yang telah dikumpulkan oleh penulis adalah dengan metode historical factual. Dalam tulisan ini juga menggunakan metode deskriptif dimana penulis menjelaskan dan menguraikan perjalanan dan pemikiran politik Thaha Husein. Thaha Husein menerima dan mengajukan konsep sekularisasi yang berbeda dengan ide sekularisme yang terjadi di Barat. Thaha Husein menunjuk sekularisasi dalam pengertian sebagai proses melepaskan umat dari ikatan tradisi, termasuk ajaran agama yang merupakan pemahaman para pendahulu terhadap nash-nash yang zhanni, dan berakhir dengan kembali kepada Alquran dan Hadits (artinya tidak terlepas dari keduanya). Divorce is a private matter, but considering the current social conditions, it requires the government to intervene to see the legal impact it causes. This study aims to find out how society responds to divorce rules in marriage law in Indonesia. This research is descriptive qualitative research with literature journals, books, and research results used as data sources, and then analyzed using content analysis techniques to find comprehensive answers. The results of the study found that there was legal dualism in society between fiqh and laws and regulations, leaving conflict between the two. In fiqh, it is stated that divorce may be carried out anywhere without being limited by space and time, however, in Indonesian marriage law it is stipulated that divorce must be carried out before a court hearing. The difficulty for the community to accept the rule of law is due to differences in social habits and values </em><em>​​</em><em>that develop in society.</em></p> <p><strong>Abstrak</strong><strong>: </strong><em>Perceraian merupakan jalan terakhir yang ditempuh ketika polemik dalam keluarga sudah memasuki kondisi darurat, setelah berbagai upaya telah dilakukan tapi tidak berhasil mempertahankan keutuhan rumah tangga. Perceraian merupakan urusan pribadi namun melihat kondisi sosial sekarang ini mengharuskan pemerintah untuk turut campur melihat dampak hukum yang ditimbulkannya. Penelitian ini bertujuan untuk mengetahui bagaimana masyarakat menyikapi terhadap aturan perceraian dalam hukum perkawinan di Indonesia. Penelitian ini merupakan riset kualitatif bersifat deskriptif dengan literatur jurnal, buku dan hasil penelitian dijadikan sebagai sumber data, dan kemudian dianalisis menggunakan teknik analysis content untuk menemukan jawaban yang komprehensif. Hasil penelitian didapatkan bahwa terjadinya dualisme hukum di masyarakat antara fiqh dan peraturan perundang-undangan sehingga menyisakan pertentangan diantara keduanya. Dalam fiqh disebutkan bahwa perceraian boleh dilakukan dimana saja tanpa dibatasi oleh ruang dan waktu, akan tetapi dalam hukum perkawinan di Indonesia ditetapkan bahwa perceraian harus dilakukan di depan sidang pengadilan. The result of this research is the knowledge</em> of <em>Sheikh Wan Hasan bin Wan Ishak's contribution to writing the book of Hidayat al-Mukhtar, a translation of the Arba'in Hadith, and also writing a translation of the book of Ayyuha al-Walad by Imam al-Gazali.</em></p> <p><em>Thailand merupakan daerah minoritas Muslim di Asia Tenggara dengan Pattani sebagai salah satu wilayahnya, salah satu ulama yang berpengaruh dalam bidang Hadis adalah Syekh Wan Hasan bin Wan Ishak al-Pattani. Adapun tujuan penelitian ini adalah untuk mengetahui kontribusi syeikh Wan Hasan bin Wan Ishak al-Pattani di bidang Hadis. </em><em>M</em><em>etode penelitian yang digunakan peneliti adalah kualitatif yang bersifat deskriptip.
