Kekosongan Hukum dalam Pembagian Warisan 1:1 di Indonesia Perspektif Kesetaraan Gender

This article examines the legal vacuum in Indonesia’s inheritance distribution system, particularly regarding the division of inheritance between male and female heirs within the context of Islamic law. The provision in the Compilation of Islamic Law (KHI), which mandates a 2:1 ratio in favor of male heirs, poses a challenge to the principles of gender equality as enshrined in the 1945 Constitution and international legal instruments such as CEDAW. Employing normative legal and theoretical approaches, including feminist legal theory and substantive justice, the study highlights the urgency of reforming inheritance law to become more inclusive and responsive to women's evolving social roles. The analysis incorporates perspectives from positive law, customary law, and Islamic jurisprudence, alongside contemporary social practices that increasingly favor equal inheritance distribution. The findings reveal that while the 1:1 inheritance division is gaining informal acceptance, it still lacks explicit legal support, leading to legal uncertainty. Thus, this study advocates for a pluralist and progressive national inheritance law that ensures justice and legal certainty for all citizens.
