KEYAKINAN HAKIM TERHADAP KETERANGAN SAKSI DALAM PEMBUKTIAN TENTANG PERKARA CERAI GUGAT DI PENGADILAN AGAMA MEDAN (ANALISIS PUTUSAN HAKIM NOMOR 597/Pdt.G/2015/PA.MDN)

ABSTRAK: Menurut ketentuan yang berlaku di Pengadilan Agama dan Pengadilan Negeri bahwa saksi adalah keterangan yang diberikan terkait dengan peristiwa yang dialami, didengar dan dilihat sendiri oleh saksi. Dalam perkara nomor 597/Pdt.G/2015/PA.Mdn Hakim menerima keterangan saksi yang dihadirkan oleh penggugat di muka persidangan, padahal saksi tidak melihat, tidak mendengar dan tidak mengetahui bahwa penggugat dan tergugat bertengkar. Dari hasil penelitian disimpulkan bahwa hakim meyakini kebenaran keterangan saksi karena ada beberapa faktor penunjang, yaitu pengaduan penggugat kepada keluarga dekat, dapat diyakini kebenarannya, karena yang mengetahui keluarga dekat, mengetahui pisah rumah meskipun tidak melihat, tidak mendengar pertengkaran antara penggugat dan tergugat. Namun hakim meyakini bahwa pisah rumah merupakan indikasi dari pertengkaran sehingga patut diyakini kebenarannya.
